Assuming you have the correct Hardtop it does indeed fit over the soft top without the need to remove the soft top. I just cannot remember if you need to unclip the rear of the soft top below the rear window. The Hardtop certainly sits on the bodywork so make sure your rubber seal is clean (no grit ...
